Acceptable Use Policy

This policy governs use of Buildfel's AI phone, SMS, and outbound calling features. Please read it carefully — as the account holder, you are legally responsible for all communications you initiate through Buildfel.
Important: Buildfel is a platform provider. You — the business owner — are legally responsible for every call and message you send through Buildfel. Misuse of our telephony features may violate federal law (TCPA) with fines up to $51,744 per violation.
1. Overview
This Acceptable Use Policy ("AUP") governs your use of Buildfel's platform, including its AI phone receptionist, SMS messaging, outbound calling, and lead management features ("Telephony Services").
Buildfel operates as a technology platform and communications infrastructure provider. We provide tools that allow your business to communicate with your customers. You — the account holder — are the sole originator of every call and message sent through Buildfel. This AUP exists to protect you, your customers, and Buildfel from legal liability arising from misuse of these tools.
Violation of this AUP may result in immediate suspension of your account, release of your provisioned phone numbers, and cooperation with law enforcement or regulatory investigations.
2. Your Legal Status as the Caller
Under the Telephone Consumer Protection Act (TCPA), FCC regulations, and applicable state telemarketing laws, the business that initiates a call or sends a text message is legally responsible for that communication — not the technology platform used to send it.
When you use Buildfel to call a lead, send an SMS follow-up, or deploy your AI receptionist, you are the "caller," "sender," or "telemarketer" in the eyes of the law. Buildfel is a conduit — similar to how a phone carrier is not responsible for what you say on a call.
This means:
- You are responsible for obtaining the required consent before contacting anyone
- You are responsible for the content of every message and call
- You are responsible for honoring Do-Not-Call requests and opt-outs
- Buildfel is not liable for calls or messages you initiate in violation of applicable law
3. Consent Requirements
Before using Buildfel's calling or SMS features to contact any person, you must have obtained the appropriate level of consent required by law.
For AI-initiated or automated calls: You must have obtained prior express written consent from the recipient. This means the person must have clearly agreed — in writing or via a signed electronic form — to receive automated calls from your business. A verbal agreement is not sufficient for automated calls under the TCPA.
For SMS messages: You must have obtained prior express written consent for marketing or promotional texts. For transactional texts (appointment reminders, invoice notifications), express consent is required, though the standard is slightly lower.
Consent best practices: - Use a clear opt-in checkbox on your website and lead capture forms — never pre-checked - State explicitly what the person is consenting to (e.g., "I agree to receive automated calls and texts from [Your Business] about my project inquiry") - Keep records of consent: date, method, and the text of the consent language shown - Never purchase or use third-party contact lists without verifiable consent records
Buildfel's embedded lead capture form includes a consent disclosure by default. If you use your own forms or collect leads through other means, you are responsible for ensuring consent was properly obtained.
4. Prohibited Uses
You may not use Buildfel's telephony or messaging features to:
Spam and Unsolicited Contact: - Send unsolicited commercial messages (spam) to any person who has not given prior express consent - Contact numbers on the National Do-Not-Call Registry without a pre-existing business relationship or written consent - Send bulk unsolicited text messages or robocalls - Use number spoofing or caller ID falsification of any kind
Harassment and Abuse: - Harass, threaten, intimidate, or abuse any person through calls or messages - Contact any person after they have asked you to stop - Send messages containing hate speech, obscene content, or threats
Fraud and Deception: - Misrepresent your identity, business name, or the nature of your business in any call or message - Conduct phishing, scams, or any fraudulent scheme through the platform - Impersonate another business or individual
Legal Violations: - Violate the TCPA, CAN-SPAM Act, or any applicable state consumer protection or telemarketing law - Contact minors for commercial purposes - Transmit content that infringes on any third-party intellectual property rights - Use the Service in any jurisdiction where such use is prohibited by local law
Platform Abuse: - Attempt to circumvent Buildfel's rate limits or usage caps - Use the Service to test or probe for vulnerabilities - Use the Service in a way that disrupts or degrades service for other users
5. Do-Not-Call Compliance
You are solely responsible for maintaining your own internal Do-Not-Call (DNC) list and for cross-referencing the National DNC Registry before initiating any outbound sales calls.
Key requirements: - You must scrub your contact lists against the National DNC Registry before calling. Access is available at donotcall.gov. - If a person asks to be placed on your Do-Not-Call list during any call or in any message, you must honor that request within 30 days and never contact them again for sales purposes. - Your internal DNC list must be maintained for a minimum of 5 years. - If you call someone on the National DNC Registry without a valid exemption, fines can reach $51,744 per violation under FCC rules.
Buildfel's AI receptionist is configured to recognize opt-out requests ("stop calling me," "remove me from your list," "don't contact me again") and log them. However, the ultimate legal obligation to maintain DNC compliance rests with you.
6. SMS Compliance (A2P 10DLC)
All commercial SMS messaging in the United States is regulated under the Application-to-Person (A2P) 10-Digit Long Code (10DLC) framework, enforced by major carriers (AT&T, Verizon, T-Mobile).
Under this framework: - Every business sending commercial SMS must register their brand with The Campaign Registry (TCR) - Every SMS use case (appointment reminders, estimates, follow-ups) must be registered as a campaign - Unregistered traffic is filtered or blocked by carriers, and violations can result in fines
Buildfel will assist you with A2P 10DLC brand and campaign registration as part of SMS activation. You are responsible for providing accurate business information for registration, including your legal business name, EIN (Employer Identification Number), business address, and a description of your SMS use case.
Providing false information for A2P registration is a violation of this AUP and may result in immediate account suspension.
7. Rate Limits and Fair Use
To protect the quality and deliverability of communications for all Buildfel users and to prevent misuse, the following rate limits apply:
- Outbound calls: A reasonable daily limit based on your plan (see your account dashboard for current limits)
- Outbound SMS: A reasonable daily limit based on your plan
- Trial accounts: 25 AI phone minutes and 30 SMS credits for the duration of the trial
These limits are calibrated for legitimate contractor businesses. If your usage approaches limits in a pattern that suggests misuse rather than normal business operations, we may review your account and request explanation before restoring or increasing limits.
Legitimate high-volume needs (e.g., large contractors with many simultaneous jobs) can be discussed by contacting support@buildfel.com.
8. Enforcement and Consequences
Buildfel actively monitors platform usage for patterns consistent with spam, harassment, or legal violations. We also respond to complaints from call recipients, carriers, and regulatory agencies.
If we determine your account has violated this AUP, we may: - Issue a warning and require acknowledgment before restoring access - Temporarily suspend your telephony features while we investigate - Permanently terminate your account without refund - Release your provisioned phone numbers back to the carrier pool - Report your activity to relevant law enforcement or regulatory agencies, including the FTC and FCC - Cooperate fully with any subpoena or legal process related to your account
You remain liable. Termination of your Buildfel account does not relieve you of legal liability for violations of the TCPA, FCC regulations, or other applicable law that occurred during your use of the Service.
9. Reporting Misuse
If you believe another Buildfel user is misusing the platform — for example, if you received an unsolicited call or message from a business using Buildfel — please report it to:

Include the phone number that contacted you, the date and time of contact, and a description of what happened. We take all reports seriously and investigate promptly.
10. Updates to This Policy
We may update this AUP from time to time to reflect changes in law, carrier requirements, or platform capabilities. When we make material changes, we will notify you by email at least 14 days before the changes take effect.
Your continued use of Buildfel's telephony features after the effective date of any updated AUP constitutes your acceptance of the new terms.
